The \u200cadministration is asking the supreme court to review a ruling by a 2-1 panel of the Cincinnati-based sixth US circuit court of appeals, one of three appeals courts that have joined with hundreds of lower-court judges in rejecting its detention practice.<\/p>\n<figure id=\"893648fb-bf12-4a34-a8a5-9c54e7733dc0\" data-spacefinder-role=\"richLink\" data-spacefinder-type=\"model.dotcomrendering.pageElements.RichLinkBlockElement\" class=\"dcr-1oq85qr\">\n<div data-print-layout=\"hide\" data-link-name=\"rich-link-3 | 3\" data-component=\"rich-link\" data-name=\"placeholder\" class=\"dcr-1rx5ky9\">\n<div data-format-theme=\"5\" data-format-design=\"0\" data-format-display=\"0\" class=\"dcr-15vltj4\"><a href=\"https:\/\/www.theguardian.com\/us-news\/2026\/jun\/26\/trump-supreme-court-immigration\" class=\"dcr-f35c0u\"><\/p>\n<div class=\"dcr-vvxpdt\">\n<div class=\"dcr-6z6e7\">\n<div class=\"dcr-zh9rih\">Trump finds partner in supreme court in his war against immigration<\/div>\n<\/div>\n<div class=\"dcr-oj13vq\">\n<div class=\"dcr-ef9nua\">Read more<\/div>\n<\/div>\n<\/div>\n<p><\/a><\/div>\n<\/div>\n<\/figure>\n<p class=\"dcr-1s160rg\">Two other appeals courts have endorsed the administration\u2019s policy, a fact the US solicitor general, D John Sauer, noted as he urged the justices to intervene and resolve a \u201ccritically important question of immigration law\u201d that is fueling thousands of lawsuits by people challenging their detention.<\/p>\n<p class=\"dcr-1s160rg\">\u201cDetaining aliens who are living in the country after an illegal entry while their \u200cremoval proceedings unfold prevents those aliens from evading hearings and helps ensure their removal from the United States,\u201d Sauer argued in a petition.<\/p>\n<p class=\"dcr-1s160rg\">Bucking a longstanding interpretation of immigration law, the US Department \u200bof Homeland Security (DHS) last year took the position that non-citizens already residing in the United States, and not just people arriving at the border, qualify as \u201capplicants for admission\u201d subject to mandatory detention.<\/p>\n<p class=\"dcr-1s160rg\">Under federal immigration law, \u201capplicants for admission\u201d to the United States are subject to mandatory detention while their cases proceed in immigration courts and are ineligible for bond hearings.<\/p>\n<p class=\"dcr-1s160rg\">The Board of Immigration Appeals, which \u2060is part of the justice department, issued a decision in September that adopted that interpretation. As \u200ba result, immigration judges, who are employed \u200bby the department, across the country began \u200bordering mandatory detention.
