Wade,<\/em> ending the constitutional right to abortion.<\/p>\n<p>&#8220;<em>Roe<\/em> was egregiously wrong from the start,&#8221; Justice Samuel Alito wrote in <a href=\"https:\/\/www.supremecourt.gov\/opinions\/21pdf\/19-1392_6j37.pdf\" target=\"_blank\">the <em>Dobbs v. Jackson Women&#8217;s Health <\/em>majority opinion<\/a> on June 24, 2022. &#8220;And far from bringing about a national settlement of the abortion issue, <em>Roe <\/em>and <a href=\"https:\/\/www.npr.org\/2022\/05\/06\/1096885897\/roe-established-abortion-rights-20-years-later-casey-paved-the-way-for-restricti\" target=\"_blank\"><em>[Planned Parenthood v.] Casey<\/em><\/a>have enflamed debate and deepened division.&#8221;<\/p>\n<p>Reversing <em>Roe <\/em>didn&#8217;t calm debate or heal division. A confusing patchwork of state laws began to take shape hours after the Supreme Court ruled \u2014 which was, perhaps, predictable. This year, voters will again <a href=\"https:\/\/www.kff.org\/womens-health-policy\/abortion-on-the-2026-ballot-the-evolving-landscape-of-state-abortion-initiatives\/\" target=\"_blank\">consider ballot measures<\/a> to protect or restrict abortion access across the country. Dramatic stories of <a href=\"https:\/\/www.npr.org\/series\/1131797158\/days-weeks\" target=\"_blank\">medical care denied<\/a> to pregnant patients <a href=\"https:\/\/www.texastribune.org\/2026\/06\/22\/texas-miscarriage-abortion-ban-hospital-complaint\/\" target=\"_blank\">continue to unfold<\/a> across the country.<\/p>\n<p>Here are four things to know about the state of abortion access in America today.<\/p>\n<h3 class=\"edTag\">1. The number of abortions continues to rise<\/h3>\n<p>You might have guessed that when more than a dozen states banned abortion, there would be fewer abortions happening in those states and that the overall number of abortions would go down.<\/p>\n<p>That&#8217;s not what has happened. The number of abortions nationally <a href=\"https:\/\/www.npr.org\/2026\/03\/24\/nx-s1-5757550\/abortion-telemedicine-travel-mifepristone-misoprostol\" target=\"_blank\">has increased each year<\/a> since the national right to abortion was overturned.<\/p>\n<p>Part of the reason is that access has become easier in states that support abortion. Policy changes have allowed more residents of those states to have abortion access without barriers like waiting periods or parental permission requirements. These lowered barriers have helped people who live in restrictive states to travel for care.<\/p>\n<p>&#8220;Shield laws&#8221; have also emerged as a major force in the abortion access landscape. States that support abortion access have created legal shields to allow clinicians to provide abortion to residents in states with bans, even without patients traveling. Clinicians can prescribe medication abortion via telemedicine \u2014 online or over the phone. Pills can then be mailed or picked up at local pharmacies.<\/p>\n<p><!-- END ID=\"MID-STORY-RECOMMENDATIONS-MOUNT-PIANO\" CLASS=\"MID-STORY-RECOMMENDATIONS-MOUNT-PIANO\" ARIA-LABEL=\"RECOMMENDED STORIES\" --><\/p>\n<p>That&#8217;s led to the surprising fact that the number of abortions in states with bans have actually increased in recent years, as telemedicine abortion has grown. And this has not escaped Justice Alito&#8217;s notice.<\/p>\n<p>&#8220;What is at stake is the perpetration of a scheme to undermine our decision in <em>Dobbs,&#8221; <\/em><a href=\"https:\/\/www.supremecourt.gov\/opinions\/25pdf\/25a1207_21p3.pdf\" target=\"_blank\">Alito wrote<\/a> in a recent dissent related to abortion pills, &#8220;which restored the right of each state to decide how to regulate abortions within its borders.&#8221;<\/p>\n<h3 class=\"edTag\">2. Anti-abortion politics have gotten complicated<\/h3>\n<p>President Trump is pulled in two directions on the issue of abortion. His appointees to the Supreme Court overturned <em>Roe vs. Wade<\/em>, a huge victory for conservatives, but he and his administration have become notably quiet on the issue in this midterm year. Why? The coalition that elected Trump in 2024 included <a href=\"https:\/\/www.pewresearch.org\/religion\/fact-sheet\/public-opinion-on-abortion\/\" target=\"_blank\">independent voters, who support<\/a> abortion rights.<\/p>\n<p>Meanwhile, anti-abortion politicians and activists want to see more action to restrict abortion, like <a href=\"https:\/\/www.npr.org\/2024\/04\/10\/1243802678\/abortion-comstock-act\" target=\"_blank\">reviving the Comstock Act<\/a>. That&#8217;s the 19th century law that says you can&#8217;t use the mail to send &#8220;obscene&#8221; materials including pornograpy and &#8220;every article or thing designed, adapted, or intended for producing abortion.&#8221; If enforced, it could create a de facto national abortion ban without requiring Congress to pass a new law.<\/p>\n<div id=\"resnx-s1-5869560-101\" class=\"bucketwrap internallink insettwocolumn inset2col \">\n<div class=\"bucket img\">\n                  <a class=\"imagewrap\" id=\"featuredStackSquareImage1243802678\" href=\"https:\/\/www.npr.org\/2024\/04\/10\/1243802678\/abortion-comstock-act\" data-metrics-ga4='{\"category\":\"recirculation\",\"action\":\"story_recirculation_click\",\"clickType\":\"inset box\",\"clickUrl\":\"https:\/\/www.npr.org\/2024\/04\/10\/1243802678\/abortion-comstock-act\"}'><img decoding=\"async\" src=\"https:\/\/media.npr.org\/assets\/img\/2024\/04\/10\/gettyimages-1481952226_sq-76e2ce8aa90ef988acd5ea3f89b081cbb72b23ce.jpg?s=100&amp;c=85&amp;f=jpeg\" data-original=\"https:\/\/media.npr.org\/assets\/img\/2024\/04\/10\/gettyimages-1481952226_sq-76e2ce8aa90ef988acd5ea3f89b081cbb72b23ce.jpg?s=100&amp;c=100&amp;f=jpeg\" data-template=\"https:\/\/media.npr.org\/assets\/img\/2024\/04\/10\/gettyimages-1481952226_sq-76e2ce8aa90ef988acd5ea3f89b081cbb72b23ce.jpg?s={width}&amp;c={quality}&amp;f={format}\" data-format=\"jpeg\" class=\"img lazyOnLoad\" alt=\"Why anti-abortion advocates are reviving a 19th century sexual purity law\" loading=\"lazy\"><\/a>         <\/p>\n<div class=\"bucketblock\">\n<h3 class=\"slug\"><a href=\"https:\/\/www.npr.org\/sections\/politics\/\">Politics <\/a><\/h3>\n<h3><a href=\"https:\/\/www.npr.org\/2024\/04\/10\/1243802678\/abortion-comstock-act\" data-metrics-ga4='{\"category\":\"recirculation\",\"action\":\"story_recirculation_click\",\"clickType\":\"inset box\",\"clickUrl\":\"https:\/\/www.npr.org\/2024\/04\/10\/1243802678\/abortion-comstock-act\"}'>Why anti-abortion advocates are reviving a 19th century sexual purity law<\/a><\/h3>\n<\/p><\/div>\n<p><!-- END CLASS=\"BUCKETBLOCK\" -->\n      <\/div>\n<p><!-- END CLASS=\"BUCKET IMG\" -->\n   <\/div>\n<p><!-- END ID=\"RESNX-S1-5869560-101\" CLASS=\"BUCKETWRAP INTERNALLINK INSETTWOCOLUMN INSET2COL \" --><\/p>\n<p>Last month, Justice Clarence Thomas <a href=\"https:\/\/www.npr.org\/2026\/05\/14\/nx-s1-5821591\/mifepristone-supreme-court-louisiana-telehealth\" target=\"_blank\">asserted in <\/a>his <a href=\"https:\/\/www.supremecourt.gov\/opinions\/25pdf\/25a1207_21p3.pdf\" target=\"_blank\"><u>dissent to the abortion pill case<\/u><\/a> that the Comstock Act was in force and that drug companies manufacturing and distributing FDA approved medications were therefore engaged in a &#8220;criminal enterprise.&#8221;<\/p>\n<p>And states are also actively pursuing more restrictions, including bills that would <a href=\"https:\/\/www.newsfromthestates.com\/article\/bills-would-classify-abortion-homicide-fizzle-while-pill-crackdowns-advance\" target=\"_blank\">charge women<\/a> who get abortions with homicide. Texas <a href=\"https:\/\/www.kut.org\/health\/2025-09-03\/texas-house-bill-seven-abortion-pills\" target=\"_blank\">passed a law<\/a> that allows private citizens to sue out-of-state prescribers of abortion pills for $100,000. Louisiana <a href=\"https:\/\/kffhealthnews.org\/health-industry\/louisiana-mifepristone-misoprostol-abortion-pills-reclassified-dangerous-controlled-substances\/\" target=\"_blank\">scheduled mifepristone and misoprostol<\/a>, the two medications used for abortion, as controlled substances.<\/p>\n<p>Louisiana also is <a href=\"https:\/\/litigationtracker.law.georgetown.edu\/litigation\/state-of-louisiana-et-al-v-food-and-drug-administration-et-al\/\" target=\"_blank\">suing the Food and Drug Administration<\/a>, aiming to force the agency to roll back the rules change that allowed telemedicine access to mifepristone. That case is <a href=\"https:\/\/www.npr.org\/2026\/05\/14\/nx-s1-5821591\/mifepristone-supreme-court-louisiana-telehealth\" target=\"_blank\">likely headed<\/a> for the Supreme Court. If the justices decide the case in Louisiana&#8217;s favor then mifepristone would no longer be available via telemedicine nationally. Other <a href=\"https:\/\/litigationtracker.law.georgetown.edu\/issues\/medication-abortion\/\" target=\"_blank\">lawsuits against mifepristone<\/a> are also pending.<\/p>\n<h3 class=\"edTag\">3. Supporters say abortion pills are &#8220;unstoppable&#8221;<\/h3>\n<p>Abortion rights advocates are pushing beyond the status quo, too. Researchers at University of California San Francisco recently <a href=\"https:\/\/www.npr.org\/2026\/04\/06\/nx-s1-5773372\/medication-abortion-jama-safety-mifepristone-misoprostol\" target=\"_blank\">published a study<\/a> examining the feasibility of making abortion medication available over-the-counter in the U.S., no doctor&#8217;s appointment or prescription needed. A Planned Parenthood affiliate  started offering abortion medication to patients who aren&#8217;t pregnant, to <a href=\"https:\/\/www.npr.org\/2026\/05\/21\/nx-s1-5827444\/abortion-pills-mifepristone-misoprostol-planned-parenthood-advance-provision\" target=\"_blank\">keep at home in case<\/a> they need it. Efforts to maintain access to in-person abortion care include training more <a href=\"https:\/\/www.npr.org\/sections\/shots-health-news\/2024\/06\/21\/nx-s1-4995771\/abortion-primary-care-family-medicine\" target=\"_blank\">primary care physicians<\/a> to offer abortion, and turning to health facilities like <a href=\"https:\/\/www.npr.org\/2026\/04\/08\/nx-s1-5773333\/planned-parenthood-urgent-care-medication-abortion-rural\" target=\"_blank\">urgent care clinics<\/a> to fill in gaps.<\/p>\n<p>In the meantime, the use of medication abortion continues to grow. &#8220;Abortion pills are everywhere, they&#8217;re safe, they&#8217;re effective, and they&#8217;re pretty much unstoppable,&#8221; Elisa Wells of Plan C, a website about medication abortion, told <a href=\"https:\/\/www.npr.org\/2026\/05\/21\/nx-s1-5827444\/abortion-pills-mifepristone-misoprostol-planned-parenthood-advance-provision\" target=\"_blank\">NPR last month<\/a>. &#8220;The genie is out of the bottle.&#8221;<\/p>\n<h3 class=\"edTag\">4. Privacy and stigma around abortion are evolving rapidly<\/h3>\n<p>Abortion was legal for nearly 50 years under a right to privacy based in the constitution. In the first trimester, according to the <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/410\/113\/\" target=\"_blank\">majority opinion<\/a> in <em>Roe<\/em>, &#8220;the abortion decision and its effectuation must be left to the medical judgment of the pregnant woman&#8217;s attending physician.&#8221;<\/p>\n<p>Ironically, since that right has been revoked, women can have abortions in far more privacy than was possible under <em>Roe<\/em>. Patients can fill out an online form and have abortion pills delivered to their homes, avoiding protesters that still gather outside some reproductive health clinics. At the same time, people embrace talking freely about the experience, eschewing shame, with hashtags like #ShoutYourAbortion.<\/p>\n<p>Some women who have shared their own painful stories about being denied medically necessary abortion and miscarriage care have become public figures. Kate Cox appealed to the Texas Supreme Court for access to abortion <a href=\"https:\/\/www.npr.org\/sections\/health-shots\/2023\/12\/13\/1218953788\/texas-abortion-ban-supreme-court-kate-cox\" target=\"_blank\">while pregnant<\/a>. Her picture was in the news as she was living through a pregnancy complication and seeking help. In the end, Texas denied her request, and she traveled out of state for an abortion.<\/p>\n<p>Still, the increasingly online experience of seeking abortion also opens up new privacy issues. Just months after the <em>Dobbs <\/em>decision, police in Nebraska <a href=\"https:\/\/www.npr.org\/2022\/08\/12\/1117092169\/nebraska-cops-used-facebook-messages-to-investigate-an-alleged-illegal-abortion\" target=\"_blank\">used Facebook messages<\/a> to bring felony charges <a href=\"https:\/\/www.nytimes.com\/2023\/09\/22\/us\/jessica-burgess-abortion-pill-nebraska.html\" target=\"_blank\"><u>in a successful case<\/u><\/a> against a woman who gave her teenage daughter abortion pills. And many Americans track their periods in apps that have raised <a href=\"https:\/\/www.npr.org\/2022\/05\/10\/1097482967\/roe-v-wade-supreme-court-abortion-period-apps\" target=\"_blank\">concerns
