That expedited removal process has for nearly three decades been used to quickly return migrants apprehended \u200bat the border.<\/p>\n<p class=\"dcr-1s160rg\">But in January 2025, the administration \u200cexpanded its scope to cover non-citizens \u200capprehended anywhere in the US who could not show that they had been in the country for two \u200cyears. The policy mirrored one the <a href=\"https:\/\/www.theguardian.com\/us-news\/trump-administration\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\">Trump administration<\/a> adopted in 2019 that the Biden administration later rescinded.<\/p>\n<p class=\"dcr-1s160rg\">After the immigrant rights advocacy group Make the Road New York sued, US district judge Jia Cobb blocked the enforcement of those new policies, saying they violate the constitutional due process rights of migrants who could be apprehended anywhere in the US.<\/p>\n<p class=\"dcr-1s160rg\">But the DC circuit disagreed in a ruling authored by circuit judge Justin Walker, a \u200cTrump appointee, who said that the Trump administration was allowed to expand \u201cexpedited removal to the maximum extent allowed by Congress\u201d.<\/p>\n<p class=\"dcr-1s160rg\">He said migrants are given notice that DHS is placing them \u200bin expedited removal and receive a chance to object, including by showing that they have been continually present in the US for two years.<\/p>\n<p class=\"dcr-1s160rg\">\u201cAt most, the district court\u2019s findings show that Congress\u2019s expedited screening system operates quickly and with practical constraints \u2013 features the statute itself contemplates,\u201d he wrote. \u201cThey do not show that the challenged directives deprive aliens of a meaningful opportunity \u2060to be heard.\u201d<\/p>\n<p class=\"dcr-1s160rg\">His opinion was joined in large part by US circuit judge Neomi Rao, \u200bwho was also appointed by \u200bTrump, and drew a dissent from US \u200bcircuit judge Robert Wilkins, an appointee of Barack Obama. Wilkins objected to allowing migrants \u200bto be subjected to \u200cthe fast-track deportation process without \u200beven being asked \u200bhow long they have been living in the .S, saying such a procedure \u201cis woefully inadequate for persons encountered in the interior of the country\u201d.<\/p>\n<p class=\"dcr-1s160rg\">James Percival, DHS\u2019s general counsel, said in a statement that the ruling \u201cvindicated our decision to apply the law as written\u201d.
