href=\"https:\/\/www.theguardian.com\/us-news\/2026\/jun\/09\/house-immigration-bill-funding\" data-link-name=\"in body link\">new law<\/a> this week that gives the Department of Homeland Security (DHS) roughly $70bn in additional funding, bankrolling his mass deportation campaign through the end of his second term in what <a href=\"http:\/\/v\/\" data-link-name=\"in body link\">critics<\/a> say amounts to a huge blow for accountability.<\/p>\n<p class=\"dcr-130mj7b\">What will this increase in the power of Immigration and Customs Enforcement (<a href=\"https:\/\/www.theguardian.com\/us-news\/ice-us-immigration-and-customs-enforcement\" data-link-name=\"in body link\">ICE<\/a>) and Customs and Border Protection (CBP) mean for the US president\u2019s sweeping <a href=\"https:\/\/www.theguardian.com\/us-news\/usimmigration\" data-link-name=\"in body link\">anti-immigration<\/a> agenda?<\/p>\n<figure data-spacefinder-role=\"inline\" data-spacefinder-type=\"model.dotcomrendering.pageElements.QAndAExplainerBlockElement\" class=\"dcr-173mewl\">\n<div data-spacefinder-role=\"nested\">\n<hr class=\"dcr-1peeo35\">\n<h2 id=\"how-is-the-funding-divided\" class=\"dcr-bry4uv\">How is the funding divided?<\/h2>\n<p class=\"dcr-130mj7b\"><a href=\"https:\/\/www.nilc.org\/articles\/whats-in-congresss-new-ice-funding-law\/\" data-link-name=\"in body link\">About<\/a> $26bn <a href=\"http:\/\/v\/\" data-link-name=\"in body link\">is going<\/a> to CBP, $38bn to ICE and $5bn more generally to DHS, with the funding available for use through 30 September 2029, about eight months after Trump is due to leave office.\u00a0And although <a href=\"http:\/\/v\/\" data-link-name=\"in body link\">the law<\/a> does include some appropriations for the agencies\u2019 other responsibilities\u00a0 \u2013 such as combating drug trafficking and child sexual exploitation \u2013 its focus is chiefly funding immigration enforcement.<\/p>\n<\/div>\n<div data-spacefinder-role=\"nested\">\n<hr class=\"dcr-1peeo35\">\n<h2 id=\"how-will-the-money-be-spent\" class=\"dcr-bry4uv\">How will the money be spent?<\/h2>\n<p class=\"dcr-130mj7b\">At US borders and entry points, the legislation includes more than $13bn for CBP\u2019s agents, support staff and operations involving immigration enforcement. Then, for policing inside the country, ICE is receiving more than $31bn for:\u00a0<\/p>\n<ul class=\"dcr-130mj7b\">\n<li class=\"dcr-130mj7b\">\n<p class=\"dcr-130mj7b\">ICE personnel enforcing immigration policy<\/p>\n<\/li>\n<li class=\"dcr-130mj7b\">\n<p class=\"dcr-130mj7b\">State and local law enforcement cooperation through highly controversial <a href=\"https:\/\/www.theguardian.com\/us-news\/ng-interactive\/2025\/apr\/30\/trump-local-police-immigration\" data-link-name=\"in body link\">287(g) agreements,<\/a> where police or other authorities conduct immigration enforcement activities on behalf of and in collaboration with the federal authorities\u00a0\u00a0<\/p>\n<\/li>\n<li class=\"dcr-130mj7b\">\n<p class=\"dcr-130mj7b\">Government attorneys to argue for deportations<\/p>\n<\/li>\n<li class=\"dcr-130mj7b\">\n<p class=\"dcr-130mj7b\">Transportation costs for repatriations\u00a0<\/p>\n<\/li>\n<li class=\"dcr-130mj7b\">\n<p class=\"dcr-130mj7b\">Information technology improvements<\/p>\n<\/li>\n<li class=\"dcr-130mj7b\">\n<p class=\"dcr-130mj7b\">Facility and fleet maintenance\u00a0<\/p>\n<\/li>\n<li class=\"dcr-130mj7b\">\n<p class=\"dcr-130mj7b\">General \u201cnecessary expenses for &#8230; mission support\u201d<\/p>\n<\/li>\n<\/ul>\n<p class=\"dcr-130mj7b\">Among the law\u2019s most <a href=\"https:\/\/www.nilc.org\/articles\/whats-in-congresss-new-ice-funding-law\/\" data-link-name=\"in body link\">controversial<\/a> provisions is at least $350m earmarked for \u201cnecessary expenses\u201d related to enforcement in places that do not actively cooperate with federal immigration officials \u00a0 \u2013 likely targeting so-called <a href=\"https:\/\/www.theguardian.com\/us-news\/2026\/mar\/06\/sanctuary-movement-lessons-ice\" data-link-name=\"in body link\">sanctuary jurisdictions<\/a>.<\/p>\n<\/div>\n<div data-spacefinder-role=\"nested\">\n<hr class=\"dcr-1peeo35\">\n<h2 id=\"what-isnt-in-the-bill\" class=\"dcr-bry4uv\">What isn\u2019t in the bill?<\/h2>\n<p class=\"dcr-130mj7b\">None of the funds can be used (except as mandated by law) to \u201cfacilitate the release into the community\u201d of a broad swathe of immigrants, including through placement in programs that might require the use of <a href=\"https:\/\/www.theguardian.com\/us-news\/2026\/mar\/27\/immigration-ice-ankle-monitors\" data-link-name=\"in body link\">ankle monitors<\/a> or virtual check-ins but at least allow people to avoid long-term <a href=\"https:\/\/www.theguardian.com\/us-news\/ng-interactive\/2025\/aug\/29\/trump-immigration-ice-cbp-data\" data-link-name=\"in body link\">detention<\/a>.<\/p>\n<p class=\"dcr-130mj7b\">Immigration advocates also say the law has <a href=\"https:\/\/www.nilc.org\/articles\/despite-being-flush-in-cash-dhs-wants-70-billion-more-in-tax-payer-dollars\/\" data-link-name=\"in body link\">omitted<\/a> guardrails meant to hold the agencies accountable, such as reporting requirements and congressional oversight of detention facilities.<\/p>\n<\/div>\n<div data-spacefinder-role=\"nested\">\n<hr class=\"dcr-1peeo35\">\n<h2 id=\"is-this-the-first-major-cash-influx-for-immigration-enforcement-under-trump-20\" class=\"dcr-bry4uv\">Is this the first major cash influx for immigration enforcement under Trump 2.0?<\/h2>\n<p class=\"dcr-130mj7b\">No.So far, <a href=\"https:\/\/democrats-appropriations.house.gov\/news\/press-releases\/delauro-republicans-are-cutting-funding-helps-working-families-afford-basic\" data-link-name=\"in body link\">DHS<\/a> has gotten about a quarter of a billion dollars from Congress amid Trump\u2019s second term. This new law comes on the heels<a href=\"https:\/\/www.congress.gov\/bill\/119th-congress\/house-bill\/1\/all-actions\" data-link-name=\"in body link\"> of HR 1<\/a>, which through the same partisan process funneled a whopping <a href=\"https:\/\/www.nilc.org\/resources\/new-funding-increases-immigration-enforcement\/\" data-link-name=\"in body link\">$170bn<\/a> into immigration enforcement last summer.<\/p>\n<p class=\"dcr-130mj7b\">There may be more to come: amid the regular appropriations process for fiscal year 2027, Republicans are <a href=\"https:\/\/immigrantjustice.org\/press-release\/taxpayers-are-not-ices-cash-cow\/\" data-link-name=\"in body link\">advocating<\/a> for ICE and CBP to receive another multibillion-dollar payout.<\/p>\n<\/div>\n<div data-spacefinder-role=\"nested\">\n<hr class=\"dcr-1peeo35\">\n<h2 id=\"did-any-of-the-democrats-demands-make-it-into-the-law\" class=\"dcr-bry4uv\">Did any of the Democrats\u2019 demands make it into the law?<\/h2>\n<p class=\"dcr-130mj7b\">The legislation\u2019s passage caps off a months-long saga that included the <a href=\"https:\/\/www.theguardian.com\/us-news\/2026\/apr\/30\/partial-government-shutdown-ends-ice-dhs-funding-republicans\" data-link-name=\"in body link\">longest<\/a> DHS shutdown ever, as Democrats pushed for reforms tied to the funding after immigration officials killed two US citizens, <a href=\"https:\/\/www.theguardian.com\/us-news\/2026\/jan\/29\/who-is-alex-pretti-ice-minneapolis-shooting\" data-link-name=\"in body link\">Alex Pretti <\/a>and <a href=\"https:\/\/www.theguardian.com\/us-news\/2026\/jan\/08\/minnesota-ice-shooting-nicole-macklin-good\" data-link-name=\"in body link\">Renee Good<\/a>, during roaming patrols in Minneapolis earlier this year.\u00a0Democrats <a href=\"https:\/\/jeffries.house.gov\/2026\/02\/04\/leaders-jeffries-and-schumer-deliver-urgent-ice-reform-demands-to-republican-leadership\/\" data-link-name=\"in body link\">wanted<\/a>, in part, to:\u00a0<\/p>\n<ul class=\"dcr-130mj7b\">\n<li class=\"dcr-130mj7b\">\n<p class=\"dcr-130mj7b\">Require DHS officers to get judicial warrants before making arrests on private property<\/p>\n<\/li>\n<li class=\"dcr-130mj7b\">\n<p class=\"dcr-130mj7b\">Mandate verifying someone is not a US citizen before detaining them\u00a0<\/p>\n<\/li>\n<li class=\"dcr-130mj7b\">\n<p class=\"dcr-130mj7b\">Ban immigration officials from hiding their faces with masks\u00a0<\/p>\n<\/li>\n<li class=\"dcr-130mj7b\">\n<p class=\"dcr-130mj7b\">Bar enforcement near schools, medical facilities and churches<\/p>\n<\/li>\n<li class=\"dcr-130mj7b\">\n<p class=\"dcr-130mj7b\">Stop DHS officers from profiling potential targets based on their location, job, language, accent, race or ethnicity<\/p>\n<\/li>\n<li class=\"dcr-130mj7b\">\n<p class=\"dcr-130mj7b\">Remove officers accused of use of force from the field during an investigation<\/p>\n<\/li>\n<li class=\"dcr-130mj7b\">\n<p class=\"dcr-130mj7b\">Mandate body-worn cameras for accountability, but not as a mechanism to track protestors<\/p>\n<\/li>\n<\/ul>\n<p class=\"dcr-130mj7b\">None of those measures made it into the bill, which passed through a partisan process that only required 50 votes \u2013 instead of the usual 60 \u2013 to advance through the Senate. Senator Lisa Murkowski of Alaska was the only Republican senator who voted against the legislation, <a href=\"https:\/\/x.com\/lisamurkowski\/status\/2062911600101605799\" data-link-name=\"in body link\">saying<\/a> that by funding the agencies for three years instead of one, as is more typical, \u201cit reduces Congress\u2019s ability to apply reasonable checks on immigration policy for the remainder of this administration and into the next\u201d.<\/p>\n<\/div>\n<div data-spacefinder-role=\"nested\">\n<hr class=\"dcr-1peeo35\">\n<h2 id=\"has-dhs-changed-its-behavior-since-the-outcry-over-minneapolis\" class=\"dcr-bry4uv\">Has DHS changed its behavior since the outcry over Minneapolis?<\/h2>\n<p class=\"dcr-130mj7b\">After former DHS secretary <a href=\"https:\/\/www.theguardian.com\/us-news\/kristi-noem\" data-link-name=\"in body link\">Kristi Noem<\/a>\u2019s sudden <a href=\"https:\/\/www.theguardian.com\/us-news\/2026\/mar\/05\/trump-kristi-noem-homeland-security\" data-link-name=\"in body link\">ousting<\/a>, her replacement, Markwayne Mullin, aspired to <a href=\"https:\/\/www.theguardian.com\/us-news\/2026\/mar\/18\/senate-markwayne-mullin-nomination-dhs\" data-link-name=\"in body link\">turn down<\/a> the volume nationally around immigration enforcement and the harms it can cause.<\/p>\n<p class=\"dcr-130mj7b\">That has meant less <a href=\"https:\/\/www.theguardian.com\/us-news\/2026\/jan\/27\/gregory-bovino-analysis-minneapolis-alex-pretti\" data-link-name=\"in body link\">swaggering<\/a> tactics <a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/jun\/07\/kristi-noem-trump-secretary-homeland-security\" data-link-name=\"in body link\">in public<\/a>, if no less aggressive enforcement itself, with an early focus around expanding <a href=\"https:\/\/www.npr.org\/2026\/05\/05\/nx-s1-5805996\/ice-pays-local-police-incentives-immigration\" data-link-name=\"in body link\">reliance<\/a> on local and state authorities to enforce immigration laws \u2013\u00a0including by effectively putting <a href=\"https:\/\/www.kenklippenstein.com\/p\/exclusive-ices-bounty-hunters\" data-link-name=\"in body link\">bounties<\/a> on children who came to the country alone.<\/p>\n<p class=\"dcr-130mj7b\">At the same time, border czar Tom Homan <a href=\"https:\/\/www.npr.org\/2026\/05\/07\/g-s1-120580\/trump-border-czar-mass-deportations\" data-link-name=\"in body link\">told<\/a> a crowd last month that they \u201cain\u2019t seen shit yet\u201d and \u201cmass deportations are coming\u201d. More recently, he has <a href=\"https:\/\/www.theguardian.com\/us-news\/2026\/jun\/08\/ice-agents-new-york-city-tom-homan\" data-link-name=\"in body link\">threatened<\/a> to send \u201cmore ICE agents than you\u2019ve ever seen\u201d to New York after the state\u2019s <a href=\"https:\/\/www.nbcnewyork.com\/news\/local\/hochul-anti-ice-protections-law-new-york\/6506909\/\" data-link-name=\"in body link\">governor signed<\/a> legislation meant to protect immigrants.<\/p>\n<p class=\"dcr-130mj7b\">And ICE has remained in the headlines as <a href=\"https:\/\/www.theguardian.com\/us-news\/2026\/jun\/07\/ice-jail-new-jersey-delaney-hall\" data-link-name=\"in body link\">protesters<\/a> inside and outside federal detention centers \u2013 notably <a href=\"https:\/\/www.theguardian.com\/us-news\/2026\/jun\/12\/delaney-hall-ice-detention-strike\" data-link-name=\"in body link\">recently<\/a> at Delaney Hall in New Jersey \u2013\u00a0and <a href=\"https:\/\/www.theguardian.com\/us-news\/2026\/may\/30\/lawsuit-camp-east-montana-texas-us-immigration-ice\" data-link-name=\"in body link\">lawsuits<\/a>, such as the one against the ICE tent jail at Fort Bliss, Texas, have shone a spotlight on allegedly inedible food, inadequate medical care and other inhumane <a href=\"https:\/\/www.theguardian.com\/us-news\/2026\/may\/30\/ice-detention-immigration-journey\" data-link-name=\"in body link\">conditions<\/a>. DHS <a href=\"https:\/\/www.theguardian.com\/us-news\/2026\/jun\/07\/ice-jail-new-jersey-delaney-hall\" data-link-name=\"in body link\">repeatedly<\/a> and consistently <a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/nov\/13\/california-ice-detention-lawsuit\" data-link-name=\"in body link\">denies<\/a> all such <a href=\"https:\/\/www.theguardian.com\/us-news\/2026\/apr\/27\/texas-ice-family-detention\" data-link-name=\"in body link\">allegations<\/a>.<\/p>\n<p class=\"dcr-130mj7b\">The administration also <a href=\"https:\/\/www.washingtonpost.com\/immigration\/2026\/05\/14\/ice-moving-forward-with-warehouse-detention-plan-despite-lawsuits-investigation\/\" data-link-name=\"in body link\">reportedly<\/a> intends to advance plans to use at least a number of the estimated $38bn in warehouses bought under Noem for mass detention despite lawsuits and investigations beleaguering that plan, although officials may be\u00a0<a href=\"https:\/\/www.nbcnews.com\/politics\/immigration\/ice-eyes-selling-mega-warehouses-purchased-mass-detention-rcna347592\" data-link-name=\"in body link\">considering<\/a>\u00a0reselling some of the facilities.<\/p>\n<\/div>\n<div data-spacefinder-role=\"nested\">\n<hr class=\"dcr-1peeo35\">\n<h2 id=\"who-is-being-affected\" class=\"dcr-bry4uv\">Who is being affected?<\/h2>\n<p class=\"dcr-130mj7b\">While the Trump administration regularly claims it is targeting the \u201c<a href=\"https:\/\/www.theguardian.com\/us-news\/2026\/feb\/22\/us-immigration-trump-administration\" data-link-name=\"in body link\">worst of the worst<\/a>\u201d, as of early April, more than 70% of the 60,311 detainees across the country <a href=\"https:\/\/tracreports.org\/immigration\/quickfacts\/detention.html#detention_held\" data-link-name=\"in body link\">had<\/a> no criminal convictions.
