Boutros told US district judge April Perry he had learned of what happenedthree weeks earlier.<\/p>\n<p class=\"dcr-130mj7b\">He said that while prosecutors were abandoning their efforts, the conduct of the protesters was \u201cunacceptable in a civilized society\u201d.<\/p>\n<p class=\"dcr-130mj7b\">The four protesters \u2013 Democratic congressional candidate Kat Abughazaleh, Michael Rabbitt, Andre Martin and Brian Straw \u2013 were charged in October with conspiring to impede an officer, a felony, at the immigration detention center in Broadview, <a href=\"https:\/\/www.theguardian.com\/us-news\/illinois\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\">Illinois<\/a>. They were among a half-dozen charged demonstrators who came to be called the Broadview Six.<\/p>\n<figure id=\"55a258e0-a32b-466a-a472-15b1022d3823\" data-spacefinder-role=\"richLink\" data-spacefinder-type=\"model.dotcomrendering.pageElements.RichLinkBlockElement\" class=\"dcr-47fhrn\">\n<div data-print-layout=\"hide\" data-link-name=\"rich-link-4 | 4\" data-component=\"rich-link\" data-name=\"placeholder\" class=\"dcr-1kyw41h\">\n<div data-format-theme=\"5\" data-format-design=\"0\" data-format-display=\"0\" class=\"dcr-1ljij2n\"><a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/oct\/31\/chicago-ice-broadview-facility-lawsuit\" class=\"dcr-1m887w9\"><\/p>\n<div class=\"dcr-ut4tvs\">\n<div class=\"dcr-1h5b6rb\">\n<div class=\"dcr-169d7yv\">Illinois advocates sue over \u2018torturous\u2019 conditions at Chicago-area ICE facility<\/div>\n<\/div>\n<div class=\"dcr-eurq8n\">\n<div class=\"dcr-fkf7vq\">Read more<\/div>\n<\/div>\n<\/div>\n<p><\/a><\/div>\n<\/div>\n<\/figure>\n<p class=\"dcr-130mj7b\">Prosecutors alleged the group surrounded an immigration agent\u2019s van with other protesters during Operation Midway Blitz, one front of the immigration crackdown that Donald Trump\u2019s administration mounted in a number of US cities after the start of his second presidency.<\/p>\n<p class=\"dcr-130mj7b\">The demonstrators were accused of banging and pushing on the vehicle, scratching the word \u201cpig\u201d on the car, and breaking a rear windshield wiper during a protest in September. They were met with teargas, pepper balls and rubber pellets during the demonstrations.<\/p>\n<p class=\"dcr-130mj7b\">The Broadway Six prosecutions began to fall apart in April when questions about grand jury transcripts surfaced and prosecutors declined to make further allegations against the demonstrators. Prosecutors had dropped charges against two of the defendants before Thursday.<\/p>\n<p class=\"dcr-130mj7b\">But the four remaining defendants faced misdemeanor charges of impeding a federal officer, though prosecutors had dismissed conspiracy charges against them.<\/p>\n<p class=\"dcr-130mj7b\">The case was due to be heard after the Memorial Day holiday but has now been dismissed with prejudice \u2013 meaning that charges cannot be refiled.<\/p>\n<p class=\"dcr-130mj7b\">As a centerpiece of legal battles over the right to protest and claims that demonstrators illegally infringed on the operation of law enforcement, the collapse of the case is a setback for the government.<\/p>\n<p class=\"dcr-130mj7b\">Attorneys for the protesters said they would seek copies of the unredacted grand jury transcripts.<\/p>\n<p class=\"dcr-130mj7b\">\u201cThe revelations of the grand jury misconduct that led to the dismissal of the charges is sadly not surprising,\u201d said Abughazaleh\u2019s defense attorney, Josh Herman. \u201cThis misguided case should have never been brought against Kat Abughazaleh or any of her co-defendants for exercising their protected first amendment rights\u201d to free speech under the US constitution.<\/p>\n<p class=\"dcr-130mj7b\">Attorneys for Martin said in a statement that their client and his co-defendants had been \u201cliving under the threat of going to prison simply for exercising their first amendment rights as decent, honorable citizens and seeking to protect their fellow human beings\u201d.<\/p>\n<p class=\"dcr-130mj7b\">After the closed-door hearing, Judge Perry said she was considering holding a hearing on possible sanctions for the US attorney\u2019s office over their actions. Boutros did not dispute the allegations, saying the conduct was upsetting and the very reason the case was being dismissed.<\/p>\n<p class=\"dcr-130mj7b\">\u201cNo one acted with the intent to mislead your honor, and I think that they were following your order to give the law,\u201d Boutros said.<\/p>\n<p class=\"dcr-130mj7b\">Thursday\u2019s developments came after Illinois state police said they were investigating the death of <a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/sep\/12\/ice-agent-shooting-chicago\" data-link-name=\"in body link\">Silverio Villegas Gonzalez<\/a>, who was shot dead by an Immigration and Customs Enforcement (ICE) agent in the Chicago suburb of Franklin Park.<\/p>\n<p class=\"dcr-130mj7b\">Meanwhile, on 20 November, the Chicago US attorney\u2019s office dropped charges against <a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/nov\/20\/charges-dropped-chicago-woman-shot-border-patrol-agent\" data-link-name=\"in body link\">Marimar Martinez<\/a>, who was shot five times by a border patrol agent after she allegedly tried to ram agents with her car.<\/p>\n<p class=\"dcr-130mj7b\">Martinez \u2013 a US citizen and Montessori schoolteacher in the <a href=\"https:\/\/www.theguardian.com\/us-news\/chicago\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\">Chicago<\/a> suburb of Oak Park \u2013 had been indicted on 5 October on charges of impeding a federal officer with a deadly weapon.<\/p>\n<p class=\"dcr-130mj7b\">Furthermore, in January, a Chicago jury acquitted Juan Espinoza Martinez, whom the <a href=\"https:\/\/www.theguardian.com\/us-news\/trump-administration\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\">Trump administration<\/a> had charged with plotting a hit on a
