Lawyers for one of the detained farm workers shared the footage with the Guardian.<\/p>\n<p class=\"dcr-130mj7b\">The officers did not have warrants to detain the workers, and a federal judge later <a href=\"https:\/\/innovationlawlab.org\/sites\/default\/files\/2026-02\/MJMA%20Dkt%2088%20Opinion%20on%20PI.pdf\" data-link-name=\"in body link\">said<\/a> the arrests appeared to be unlawful and <a href=\"https:\/\/innovationlawlab.org\/sites\/default\/files\/2026-02\/MJMA%20Dkt%2088%20Opinion%20on%20PI.pdf\" data-link-name=\"in body link\">unjustified<\/a>.<\/p>\n<p class=\"dcr-130mj7b\">The footage shows an agent using his phone to capture the face of one of the detained workers, and agents later admitted in court that they used a facial recognition app during the operation. The case provides a window into ICE\u2019s expanding use of this surveillance technology <a href=\"https:\/\/www.theguardian.com\/technology\/2026\/jan\/27\/ice-facial-recognition-minnesota\" data-link-name=\"in body link\">across the US<\/a>, which has raised significant <a href=\"https:\/\/www.aclu-wi.org\/news\/mobile-fortify-ices-dystopic-facial-recognition-app\/\" data-link-name=\"in body link\">privacy<\/a> and civil liberties <a href=\"https:\/\/www.cnn.com\/audio\/podcasts\/terms-of-service-with-clare-duffy\/episodes\/3d426008-af5d-11f0-b539-7fef0a9b3b1d\" data-link-name=\"in body link\">concerns<\/a>, particularly since the app can <a href=\"https:\/\/www.404media.co\/ices-facial-recognition-app-misidentified-a-woman-twice\/\" data-link-name=\"in body link\">yield<\/a> <a href=\"https:\/\/www.markey.senate.gov\/imo\/media\/doc\/letter_to_ice_on_mobile_facial_recognition_tech1.pdf\" data-link-name=\"in body link\">inaccurate<\/a> <a href=\"https:\/\/www.wired.com\/story\/cbp-ice-dhs-mobile-fortify-face-recognition-verify-identity\/\" data-link-name=\"in body link\">results<\/a>.<\/p>\n<p class=\"dcr-130mj7b\">In the early morning on the day the footage was filmed, a team of ICE agents surveilled an apartment complex in Woodburn, a city south of Portland and home to many agricultural workers. An officer identified in court as JB later <a href=\"https:\/\/innovationlawlab.org\/sites\/default\/files\/2026-01\/12-02-2025%20M-J-M-A%20v.%20Wamsley,%20et%20al.%20Combined%20_0.pdf\" data-link-name=\"in body link\">testified<\/a> that the agents had <a href=\"https:\/\/www.theguardian.com\/us-news\/2026\/mar\/13\/ice-agent-court-testimony-oregon\" data-link-name=\"in body link\">chosen that location<\/a> in part based on data surfaced from an ICE mobile <a href=\"https:\/\/www.404media.co\/elite-the-palantir-app-ice-uses-to-find-neighborhoods-to-raid\/\" data-link-name=\"in body link\">app called Elite<\/a>, which was <a href=\"https:\/\/blog.palantir.com\/correcting-the-record-response-to-the-eff-january-15-2026-report-on-palantir-4b3a12536cd2\" data-link-name=\"in body link\">built<\/a> by the tech firm Palantir. The agent said the app helps officers find areas where they might find \u201ctargets\u201d to potentially detain.<\/p>\n<p class=\"dcr-130mj7b\">Agents decided to follow a white van leaving the apartment complex after running license plates and discovering the van\u2019s owner was potentially an immigrant in the US without authorization, JB said. The officer said in court they did not confirm whether the driver of the van was, in fact, the vehicle\u2019s owner, but that he felt it was suspicious the driver was making multiple stops for passengers: \u201cYou don\u2019t know if it\u2019s human trafficking or smuggling.\u201d<\/p>\n<p class=\"dcr-130mj7b\">Lawyers with Innovation Law Lab, an immigrant rights\u2019 non-profit that filed the class-action and represented one of the farm workers, said the van was simply carpooling to a job site.<\/p>\n<p class=\"dcr-130mj7b\">The body-cam video starts when officers pull over the van. It was around 5.30am and still dark out. Bust it!\u201d one of the officers said, referring to the van\u2019s windows. An officer then shouted commands in Spanish to open the window, but within seconds, shattered the van\u2019s side window before occupants could comply.<\/p>\n<p class=\"dcr-130mj7b\">A 45-year-old woman visible in the footage, identified as MJMA, is a farm worker and lead <a href=\"https:\/\/innovationlawlab.org\/sites\/default\/files\/2025-12\/031%20Decl%20of%20Petitioner%20MJMA%20ISO%20Habeas.pdf\" data-link-name=\"in body link\">plaintiff<\/a> in the lawsuit. The video captured her asserting her rights to remain silent, saying in Spanish, \u201cWe don\u2019t have to answer,\u201d and indicating she wanted a lawyer. She also instructed the others in the car not to speak as she called 911.<\/p>\n<p class=\"dcr-130mj7b\">An officer identified in court as CM, whose body camera was recording the encounter, then said to another officer on scene: \u201cShe wants to lawyer up. They\u2019re on the phone, making \u2026 calls and stuff.\u201d<\/p>\n<p class=\"dcr-130mj7b\">He then grabbed MJMA and took her out of the car as she said in Spanish: \u201cThis can\u2019t happen to us! They\u2019re using force. No, no, no!\u201d The officer then broke her phone, she later testified. The agent held the phone up for about 12 seconds while the phone appeared to be scanning the man\u2019s image.<\/p>\n<p class=\"dcr-130mj7b\">Later in the video, one of the officers was heard saying: \u201cMobile Fortify couldn\u2019t find him.\u201d<\/p>\n<p class=\"dcr-130mj7b\">Mobile Fortify is the Department of Homeland Security\u2019s (DHS) <a href=\"https:\/\/www.theguardian.com\/technology\/2026\/jan\/27\/ice-facial-recognition-minnesota\" data-link-name=\"in body link\">facial recognition app<\/a>, which officers use to scan the faces of individuals, cross-referencing it with various databases to try to identify them.<\/p>\n<div class=\"dcr-sso2in\">\n<figure class=\"video-container loop \" data-component=\"gu-video-loop\">\n<div class=\"dcr-wrt9nd\">\n<div class=\"dcr-n1or72\"><video id=\"video-7bb3bb1c-ec66-44bf-8d94-9bb9f547ec84\" data-testid=\"self-hosted-video-player\" data-chromatic=\"ignore\" preload=\"none\" loop=\"\" muted=\"\" playsinline=\"\" class=\"dcr-1p3pjnr\"><img decoding=\"async\" alt=\"Officer uses a facial recognition app to try to identify a detained worker\" src=\"https:\/\/i.guim.co.uk\/img\/uploads\/2026\/05\/20\/Officer_uses_a_facial_recognition_app_to_try_to_identify_a_detained_worker--7bb3bb1c-ec66-44bf-8d94-9bb9f547ec84-2.0.0000000.jpg?width=120&amp;dpr=1&amp;s=none&amp;crop=5%3A4\" loading=\"lazy\" data-chromatic=\"ignore\" class=\"dcr-l300o4\"><\/video><\/div>\n<\/div><figcaption data-spacefinder-role=\"inline\" class=\"dcr-fd61eq\"><span class=\"dcr-1alawo7\"><\/span><span class=\"dcr-1qvd3m6\">Officer uses a facial recognition app to try to identify a detained worker<\/span><\/figcaption><\/figure>\n<\/div>\n<p class=\"dcr-130mj7b\">DR, an agent involved in the Woodburn arrests, was asked about the app in court and acknowledged he didn\u2019t know what databases it used and didn\u2019t know the rate of accuracy, saying: \u201cI\u2019m not certain on the technical aspects.\u201d<\/p>\n<p class=\"dcr-130mj7b\">A female agent on the scene, identified as MK, testified that she did a \u201cfacial recognition mobile query\u201d on MJMA, which led to a match with a \u201cvery \u2026 similar person\u201d. The agent, however, said: \u201cI wasn\u2019t sure if it was her or not.\u201d The match was a woman named Maria, the agent said. The agents then started saying the name, \u201cMaria\u201d to see if MJMA might respond, but she didn\u2019t, the agent testified.<\/p>\n<p class=\"dcr-130mj7b\">The woman\u2019s name is not Maria.<\/p>\n<p class=\"dcr-130mj7b\">The agent did another facial scan of MJMA and it came up with a different match, according to MK\u2019s testimony. But MJMA continued to stay silent.<\/p>\n<p class=\"dcr-130mj7b\">The agent testified that she believed MJMA \u201cwas in the country illegally\u201d because she was only speaking Spanish and due to the \u201cpossible match\u201d from facial recognition. Her scanning of MJMA was not caught on the body-cam footage.<\/p>\n<p class=\"dcr-130mj7b\">During cross-examination, CM, the only agent who recorded body-cam footage, acknowledged he did not know the identity of any passengers when the officers stopped the van. The agent JB also revealed in court that his team was given a verbal order to target eight arrests per day, providing rare insight into DHS <a href=\"https:\/\/www.theguardian.com\/us-news\/2026\/mar\/13\/ice-agent-court-testimony-oregon\" data-link-name=\"in body link\">arrest quotas<\/a>.<\/p>\n<p class=\"dcr-130mj7b\">Four of the people detained from the van were later deported, according to a DHS spokesperson.<\/p>\n<p class=\"dcr-130mj7b\">Nelly Garcia Orjuela, Innovation Law Lab staff attorney, said MJMA had an ongoing asylum case.<\/p>\n<p class=\"dcr-130mj7b\">US judge Mustafa Kasubhai ruled against ICE in February in the class-action suit led by MJMA. He said officers had engaged in \u201cmisconduct\u201d in <a href=\"https:\/\/www.theguardian.com\/us-news\/oregon\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\">Oregon<\/a> and issued a preliminary decision broadly restricting agents in the state from arresting people without warrants.<\/p>\n<p class=\"dcr-130mj7b\">Kasubhai noted that officers had made inaccurate statements in their reports about the Woodburn encounter, including falsely saying MJMA had entered the US unlawfully when she had arrived with a valid temporary visa. He said the claims of possible \u201csmuggling\u201d were \u201cunfounded\u201d, and noted that ICE\u2019s reports inaccurately called the stop \u201cconsensual\u201d.<\/p>\n<p class=\"dcr-130mj7b\">The judge was also critical of the officers\u2019 use of the facial recognition technology, saying it relied on data that \u201ccan be inaccurate and produce individuals who are here in accordance with immigration laws\u201d.<\/p>\n<p class=\"dcr-130mj7b\">The judge further said that in the Woodburn stop, officers \u201cdid not provide any meaningfully reasonable time for the driver to comply with his commands before shattering the driver side window\u201d.<\/p>\n<p class=\"dcr-130mj7b\">DHS did not respond to questions about the officers\u2019 use of facial recognition during the arrests, but a spokesperson said in a statement that Mobile Fortify was a \u201clawful law-enforcement tool developed under the Trump administration to support accurate identity and immigration-status verification during enforcement operations\u201d.<\/p>\n<p class=\"dcr-130mj7b\">The app queries \u201climited\u201d immigration datasets from Customs and Border Protection and \u201coperates with a deliberately high matching threshold\u201d, the spokesperson said. The app is used \u201cin accordance with all applicable legal authorities\u201d, the statement added. The Elite app, the spokesperson said, \u201ccentralizes information\u201d from multiple federal agencies, allowing officers in the field to check individuals\u2019 immigration status and criminal records.<\/p>\n<p class=\"dcr-130mj7b\">The DHS spokesperson further defended ICE\u2019s practice of arresting people without warrants, saying \u201cofficers use \u2018reasonable suspicion\u2019 to investigate immigration status and probable cause to make arrests\u201d and that it had the <a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/sep\/08\/trump-supreme-court-ice-immigration-california\" data-link-name=\"in body link\">support<\/a> of the US supreme court. The statement said the seven people detained in Woodburn were undocumented and three of the workers who were deported had \u201caccepted voluntary departure\u201d. Those removed, the statement said, \u201creceived full due process\u201d.<\/p>\n<p class=\"dcr-130mj7b\">The Department of Justice did not respond to inquiries about the case.<\/p>\n<p class=\"dcr-130mj7b\">Garcia Orjuela said the videos showed the brutality of ICE\u2019s arrest strategies, with agents immediately smashing windows and bypassing people\u2019s fundamental legal protections. \u201cMJMA asserted her right to remain silent and was advising the other passengers in the car. The officers didn\u2019t like that. It makes them do their job.\u201d She added: \u201cYou have to know who you\u2019re targeting before you arrest somebody.
